These Terms of Service ("Terms") are an agreement between you and Image 3 ("we", "us", "our") about your use of image-3.ai, the GPT Image 3 tools, and every other feature on the site (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
Image 3 lets you create and edit images and videos with AI models such as GPT Image 3 by typing prompts and uploading reference files. We may add, change, or remove features at any time, and we may change which AI models are available.
You must be at least 13 years old (or the minimum age in your country) to use the Service, and at least 18 to buy a plan. You are responsible for keeping your login details safe and for everything that happens under your account. Tell us right away if you think someone else is using it. One person may hold one account. Accounts created to abuse free credits, referral rewards, or promotions may be closed without notice.
Generations cost credits. The number of credits for each model, resolution, and duration is shown in the generation panel before you click Generate. Credits are deducted when a generation starts. If a generation fails on our side, the credits are returned automatically.
Free credits. New accounts, daily check-ins, invitations, feedback, and share rewards may grant free credits. Free credits and free generations have limits, may expire, may be restricted to certain models or resolutions, and can be changed or ended at any time.
Plans. Paid plans are billed monthly or yearly in advance and renew automatically until you cancel. You can cancel anytime from the Account page; you keep access until the end of the period you paid for. Credit packs are one-time purchases. Prices are shown before checkout and may change for future billing periods with notice.
Refunds. Because credits are consumed immediately, payments are non-refundable except where required by law or where we clearly failed to deliver the Service. If you believe you were charged in error, email us within 14 days and we will look into it.
Payments are handled by third-party processors such as Stripe. Their terms apply to the payment itself.
Your inputs. You keep all rights to the prompts and files you upload ("Inputs"). You give us a limited license to store and process your Inputs so we can run the Service for you, including sending them to the AI model providers that power the Service. You promise that you have the right to upload your Inputs and that they do not violate anyone else's rights.
Your outputs. As between you and us, you own the images and videos the Service generates for you ("Outputs"), to the extent allowed by law. On a paid plan you may use Outputs for commercial purposes, and you can download a commercial license certificate from your account. On the free plan, Outputs are for personal, non-commercial use. Outputs made by AI may be similar to Outputs made for other users from similar prompts; we cannot guarantee uniqueness.
Public sharing. If you make an Output public, submit it to a gallery, or share it for a reward, you allow us to display it on the Service and in our marketing with credit to your account name where practical. You can ask us to remove it at any time.
We may use anonymized, aggregated usage data to improve the Service. We do not sell your Inputs or Outputs.
You agree not to use the Service to:
We use automated and human review to enforce these rules. We may remove content, withhold rewards, suspend, or terminate accounts that break them, and we may report illegal activity to authorities.
The Service is provided "as is" and "as available". AI models can make mistakes: Outputs may be inaccurate, offensive, or unsuitable for your purpose, and text or details in images may be wrong. You are responsible for reviewing Outputs before you use them. We do not guarantee that the Service will be uninterrupted, error-free, or that any particular model will remain available.
To the fullest extent allowed by law, Image 3 and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months before the claim, or 50 US dollars if you paid nothing.
You agree to indemnify and hold us harmless from claims arising from your Inputs, your Outputs, or your breach of these Terms.
We may suspend or end your access to the Service if you break these Terms, if required by law, or if we stop offering the Service. You may close your account at any time from the Account page. Sections 3, 5, and 6 survive termination.
These Terms are governed by the laws of the jurisdiction where Image 3 is established, without regard to conflict-of-law rules, and disputes will be resolved in the courts there unless local consumer law gives you other rights. If any part of these Terms is found unenforceable, the rest remains in effect. We may update these Terms; material changes will be posted here with a new date, and continued use after that means you accept them.
